In the case regarding the shooting death of a person in Kocaeli's Izmit district in 2022, two defendants were tried again after the Supreme Court's reversal decision. The court board complied with the reversal order and ruled that one defendant should be acquitted of the crime of "attempted intentional murder" against two people, and that the other defendant, whose acquittal decision was reversed, should be sentenced to 11 years in prison for the same crime.
The incident took place on June 19, 2022, on Şahabettin Bilgisu Street, Kemalpaşa District, Izmit district. Mertcan Pekatik (22) went to the entertainment venue with his friends Burak D., Cemal B., Mert E. After a while, an argument broke out between Burak D., Cemal B., Mert E. and their employees. After the argument, all 3 people were taken out by the employees. Mercan Pekatik, who was in the toilet at that time, went out to her friends when she learned about the situation.
Mertcan and his friends started arguing with raw meatball seller Selçuk Seis in the alley 50 meters away from the venue. In the ensuing fight, Selçuk Seis opened 4 shots with a gun. Mertcan Pekatik, who was hit by 2 bullets, died in the hospital where he was taken. Onurcan Güldağ, Onur A. and Sedat K., who were with Selçuk Seis during the fight, were taken into custody. While Selçuk Seis was arrested, the other defendants were released.
At the verdict hearing held at Kocaeli 4th High Criminal Court on December 14, 2023, Selçuk Seis was sentenced to life imprisonment for "deliberate murder" and 27 years in prison for "deliberate attempted murder" of the victim's 3 friends. Unarrested defendants Onur A., Mustafa K., Onurcan Güldağ and Sedat K. were also acquitted due to lack of evidence.
Upon appeal of the decision, the Supreme Court examined the file and sent the file back to Kocaeli 4th High Criminal Court, requesting the acquittal of Selçuk Seis against Burak D. and Cemal B., and that Onurcan Güldağ, who was acquitted in the local court, be punished for the crime of "intentional attempted murder".
At the hearing at the Kocaeli 4th High Criminal Court, the undetained defendant Onurcan Güldağ and the party lawyers were present in the hall, while the defendant Selçuk Seis was connected via Audio and Video Information System (SEGBİS). The defendants, who made the floor at the hearing, left it to the court's discretion whether to comply with the Supreme Court's reversal order. In his opinion, the public prosecutor demanded that the Supreme Court decision be complied with. Defendant Onurcan Güldağ denied the accusations and asked for his acquittal.
Complying with the decision of reversal of the Supreme Court, the court decided to acquit the defendant Selçuk Seis on the charge of "deliberate attempt to kill" the complainants Burak D. and Cemal B., and to sentence Onurcan Güldağ to 11 years in prison and arrest him for the crime of "deliberate attempt to kill". - KOCAELİ
