A verdict was announced in the case regarding the death of the security guard who was stabbed in the heart and died in a fight in front of the hotel where he worked, just days before his wedding in Antalya. While the court reduced the life imprisonment sentence given to the detained defendant Eyyüp T. to 18 years with a reduction of unfair provocation, it decided to continue the judicial control measure for the unarrested defendant Halil S., who received a 9-year prison sentence. Mother Nimet Göker said, "My son is underground, but the other person is outside freely." Father Adnan Göker reacted to the decision by saying, "My child will lie underground for the rest of his life, and we have been sentenced to life imprisonment."
The incident took place at around 02:00 on November 9 last year, in front of a hotel in Musalla Street, Selçuk District, Muratpaşa district. According to the information obtained, Tahsin Göker and Talat K.B., who worked as security guards at the hotel, warned Eyyüp T. and Halil S. on the grounds that they were drinking alcohol and making noise in front of the hotel. The discussion that started between the parties after the warning quickly turned into a fight. Tahsin Göker, who was stabbed in the chest area during the fight, could not be saved despite all the intervention of the doctors in the hospital where he was taken. In the indictment prepared by the Antalya Chief Public Prosecutor's Office, it was requested that the defendant Eyyüp T. be punished for the crimes of "intentional murder", "simple wounding with a gun with possible intent" and "opposition to Law No. 6136". A penalty was requested for Halil S. for "deliberate murder".
The third hearing of the case regarding the death of security guard Tahsin Göker, who lost his life in a knife fight in front of the hotel where he worked just days before his wedding, was held at Antalya 4th High Criminal Court. The detained defendant Eyyüp T., the unarrested defendant Halil S., the lawyers of the parties and Tahsin Göker's mother Nimet and father Adnan Göker attended the hearing.
At the hearing, the defendant Halil S., who was not detained, stated that he agreed with his lawyer's defense and said, "I did not attempt to kill anyone. I am sorry for the incident."
Arrested defendant Eyyüp T. argued that he did not act with the intent to kill and said, "I am very sorry for everything I did. I never had an intention to kill, the incident happened suddenly. I apologize to his family many times, I am very sorry."
In his opinion on the merits announced at the previous hearing, the public prosecutor requested that the detained defendant Eyyüp T. be sentenced to life imprisonment for the crime of "deliberate murder". The prosecutor wanted Halil S. to be punished and arrested as the person who helped carry out the incident, even though he did not directly participate in the crime with his actions.
The court panel announced its decision after the final defenses of the defendants and the party's lawyers. The committee first sentenced Eyyüp T. to life imprisonment for the crime of "intentional murder" against Tahsin Göker, and then the sentence was reduced to 18 years by applying a reduction of unfair provocation. The defendant Eyyüp T. was sentenced to 6 months in prison for possessing an unlicensed weapon. Halil S. was sentenced to 9 years in prison with a reduction of unfair provocation, citing the blows he received during the fight. On the other hand, the court did not order the defendant's arrest and decided to continue the current judicial control measure against him.
Making a statement in front of the courthouse after the hearing, the family's lawyer Arif Çelik said that the decision did not satisfy them and the Göker family. Reminding that the prosecutor's opinion requested that no unfair provocation discount be applied, Çelik said, "The decision given did not satisfy us and the family. The opinion prepared by the prosecutor's office was also prepared to not apply an unfair provocation discount, but the decision was made to apply an unfair provocation discount. One of the defendants was sentenced to 18 years in prison, the other to 9 years in prison. The defendant, who received a lesser sentence, was released pending trial. This situation devastated the family for the second time."
Stating that they will take legal action against the decision, Çelik said, "We will make our objections to both the high criminal court and the appeal. There was no reason to apply an unfair provocation reduction here. The prosecutor's opinion was also in this direction. We will take the decision to a higher court. Such events happen every day. The fact that the defendants receive less punishment encourages people who will attempt such crimes."
"My son is under the ground, the other person is outside"
Stating that the decision made after the death of her son increased her pain even more, mother Nimet Göker said, "I am not at all satisfied with the result we got today. I am very sorry, this should not be justice. My son is under the ground, but the other person is being sentenced to 9 years with his hands free and is currently outside. As long as I live, we will resort to whatever we need to the end. If my son is lying under the ground, they will also suffer a lot of punishment."
Stating that similar events occur every day, mother Göker continued her words as follows:
"I see it on the news every day, many mothers like me experience the same pain, but those who commit this crime are wandering the streets with very little punishment. If it continues like this, more of our children and young people will be stabbed, killed and beaten. These children are brought up and brought up very difficultly. They are our lives. I beg people in high positions, please look at your conscience. A child is very difficult to raise. It should not be this simple. I beg you, hear my voice now. I will fight until the end.
