The annulled ban decision was reviewed by the 8th Chamber of the Council of State (Danıştay) upon the İzmir Metropolitan Municipality's appeal. The Council of State ruled that paid shuttle transportation in İzmir could only be carried out with commercially registered ‘S' plate vehicles, thereby overturning the local court's annulment decision. With the new regulation, it was decided that paid student shuttle transportation can only be carried out with ‘S' plate restricted commercial vehicles, and the permits of those found to be providing paid student transportation with their own (özmal) vehicles will be revoked. According to the details conveyed; Hasan Basri Bostancı, President of the İzmir Bus and Shuttle Operators Chamber of Tradesmen, made statements on the matter, saying, "One of the most victimized segments is the shuttle operators. There are certain groups that unfairly share the livelihood of the shuttle operators. These are vehicles engaged in ‘özmal' (own-vehicle) transportation. Just as we have always fought against those who unfairly eye the tradesmen's livelihood, we are fighting today. This happened for the first time in Turkey. Before the election, we said, 'özmal is our red line.' The UKOME decision was signed on July 8. Before this decision, specifically in Article 24 titled 'Prohibitions' of the İzmir Metropolitan Municipality Service Vehicles Directive, there was a provision stating that ‘private educational institutions cannot provide student shuttle transportation for a fee with their own vehicles.' During our break, private school owners took this to court and obtained the annulment of this decision from the court. Later, the local court's decision was also upheld by the appellate court. However, we did not give up and took the matter all the way to the Council of State (Danıştay). With the decisions of the Council of State, a ruling was issued that student shuttle transportation cannot be carried out, directly or indirectly, with özmal vehicles. Student transportation cannot be carried out, directly or indirectly, with özmal vehicles registered in the name of the school."
