It was requested that he be sentenced to life imprisonment
The family and party lawyers of the detained defendant Arda K. and the victim Ferhat Ozan Yıldırım attended the second hearing of the case held at Kocaeli 3rd High Criminal Court. Announcing his opinion on the merits, the public prosecutor requested that the defendant be sentenced to life imprisonment without any reduction for unjust provocation for the crime of 'intentional murder'.
Asked what he would say against the opinion, the defendant said, "I just wanted to defend myself. I demand favorable reductions from the upper limit. I am not a murderer, I did not want to kill deliberately. I wish this incident had not happened."
Announcing its decision, the court panel evaluated the defendant's action within the scope of 'causing death as a result of intentional injury' and sentenced the defendant to 11 years and 3 months in prison, applying reductions for 'good conduct' and 'unfair provocation'.
Arda K., the detained defendant who made his defense at the first hearing, said that he and the deceased Ferhat Ozan Yıldırım worked as courier in the same company and that there was no hostility between them. The defendant made the following allegations regarding what happened on the day of the incident:
"On the day of the incident, he kicked my motorcycle and swore at me, claiming that I drove the motorcycle towards him. We started swearing. Then we got into a fight. He is bigger than me. When he pushed me towards the motorcycle, I took the knife in the basket to scare him. I did not hit him with the knife the first time. We continued to fight. When he tried to kick me, the knife came to his leg. Those who heard the voice tried to separate us. Ferhat went towards the elevator. Then, when he saw the blood on his leg, he came back. He hugged my throat and said, "I'm going to kill you, I'm going to kill you," he said. "I swung the knife once. Then he left me and started making tampons. I wish I had eaten dinner together at noon." - KOCAELİ
